Nationally consistent OHS rules will soon be a reality.
Safe Work Australia’s draft model Safe Work Act 2009 is an important milestone in the harmonisation of Occupational Health and Safety legislation in Australia. The model Act finally creates a level playing field for all stakeholders, regardless of their jurisdiction.
Even though the reforms are a big step in the right direction, there is still work to be done to realise the potential of a harmonised system. Poorly defined responsibilities under some sections of the Act will create uncertainty about exactly who must do what, and when, particularly when it comes to tenanted areas.
There are also disproportionately high penalties for some offences under the Act.
The Property Council of Australia has stated these concerns in a submission to Safe Work Australia, which you can read here. The model Act is expected to be released early in 2010, and the supporting regulations should be released soon after.
The Property Council will continue to engage with Safe Work Australia to make sure Australia gets a fair and balanced OHS system.
