The property industry has not fared well through the preparation of guidelines or advisory codes. There are oft cited examples of non-statutory guidance material being applied very strictly at the local government level (the 'rules of thumb' within the Residential Flat Design Code spring to mind in this instance). Our concern in this respect has been underpinned by clear reference in the Metropolitan Plan (December 2010) to the Guidelines being used 'as a basis for relevant Development Control Plans and assessment of development proposals’.

Absent from the planning principles drafted for the Bays Precinct is any reference to the growth and redevelopment which will be necessary to incorporate future housing, employment (commercial office, retail etc), educational and other uses. Save a general reference to 'provid(ing) for new and existing communities', there is no indication that any significant redevelopment will be required to occur at all. The principles focus a great deal on the desire achieve design excellence, sustainability and cultural dividends and an improved public domain without outlining the growth context in which these outcomes will be achieved.

Most of the proposed amendments are not underpinned by evidence of a failure of existing policy and have no appreciation of the additional administrative burden and associated costs that will be experienced by landlords. At the very least, all proposals should be held over until the Retail Leases Act is formally reviewed, as scheduled, in 2012.
