Queensland Transport recently advised the Property Council of the definition of the term “road” in the Transport Operations (Road Use Management) Act 1995.

Under that Act, the term also includes shopping centre car parks, as well as the usual inclusions of bridges, culverts, railway crossings and tunnels.

The department specifically noted that areas of property constructed as car parks that are open to the public may essentially also be roads for the purpose of this operational legislation, and subject to the installation of official traffic signs.

Queensland Transport recommended that property owners who have concerns about traffic signs should refer the matter to their local government.
